Keeping Our Eyes on the Ball
It's no secret that nursing home abuse and neglect is a widespread problem. Congress has investigated, has held extensive hearings on the issue and has passed several laws and regulations. State legislatures have done likewise — all in an effort to fix the problem.
Still, the problem remains.
Why? In simplest terms, the game is rigged. How so? Despite all the laws and regulations dictating everything from proper staff-to-resident ratios to the daily food and fluid intake of residents with certain types of conditions, there is actually very little official enforcement. In fact, most nursing homes know when the state is going to inspect their facilities so they simply "staff up" and make everything look nice and neat before the inspectors arrive.
If you feel that a loved one is being abused or neglected by the staff at their nursing home, you will likely need the help of an experienced attorney to prove it. Our advocates know the nursing home game and have developed winning strategies that help victims of abuse and neglect get justice. Getting Away With It on a Daily Basis
The quickest way for a nursing home to increase its profits is to cut its labor costs. Most often, this means higher resident-to-caregiver ratios and more poorly trained staff, but it can also mean substandard food and equipment. The decision to put profits before care, of course, creates other problems.
For instance, when there is one caregiver on duty for every 10 or 12 residents, the temptation to overmedicate residents as a means of control is greater. In addition, with too few staff on duty at any given time, the job can't be done right even by competent and caring staff. The result is that patients are neglected, and suffer daily misery, indignity, preventable decline and premature death.
Providers are able to get away with abuse and neglect on a daily basis because for the vast majority of the year, no one is keeping an eye on them.
